These Terms of Service ("Terms") govern your access to and use of Katana AI Studio (the "Service"), operated by Katana AI Studio ("we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Service. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into these Terms.
2. Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at info@katana-ai.studio of any unauthorized access or suspected breach of security. We are not liable for any loss or damage arising from your failure to safeguard your account.
3. The Service
Katana AI Studio provides a web-based interface for generating AI video content using third-party AI models. The Service is provided on an "as is" and "as available" basis. We may add, modify, or discontinue features at any time without notice. Access to specific AI models depends on the availability and policies of the underlying model providers.
4. Credits and Payments
The Service uses a credit-based pricing model. Credits are purchased in packs through our payment processor, Stripe. Each content generation consumes a number of credits based on the selected model, settings, and output. Credit costs are displayed before each generation.
New accounts may receive welcome credits at our discretion. Welcome credits are non-transferable and have no cash value. Purchased credits do not expire. All prices are in U.S. dollars unless otherwise noted.
You are responsible for all applicable taxes, except for taxes based on our net income. We reserve the right to change pricing at any time; price changes will not affect credits already purchased.
5. Content Ownership and License
You retain ownership of the prompts and inputs you submit to the Service ("Inputs") and the outputs generated from those Inputs ("Outputs"), subject to the terms of the underlying AI model providers. Because AI-generated outputs may be similar or identical across users, we cannot guarantee uniqueness or exclusivity.
You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, and display your Inputs and Outputs solely for the purpose of operating, maintaining, and improving the Service.
6. Acceptable Use
You agree not to use the Service to generate, upload, or share content that:
- Is illegal, infringes intellectual property rights, or violates the privacy of others;
- Depicts minors in sexual or suggestive contexts (CSAM) - this is strictly prohibited and will result in immediate account termination and reporting to authorities;
- Constitutes non-consensual intimate imagery or deepfakes of real individuals without their consent;
- Promotes violence, terrorism, self-harm, or illegal activity;
- Contains hate speech, harassment, or discriminatory content;
- Is designed to deceive, defraud, or impersonate others;
- Violates the policies of any underlying AI model provider.
You also agree not to reverse-engineer, scrape, or attempt to circumvent rate limits or security measures of the Service. We may suspend or terminate accounts that violate these rules, with or without notice.
7. Third-Party Services
The Service relies on third-party AI model providers and cloud infrastructure. Your use of the Service is also subject to the terms and acceptable-use policies of these providers. We are not responsible for the availability, accuracy, or content of third-party services.
8. Termination
You may close your account at any time by contacting info@katana-ai.studio. We may suspend or terminate your account if you violate these Terms, misuse the Service, or for any reason at our reasonable discretion. Upon termination, your right to use the Service ceases immediately. Unused purchased credits may be refundable per our Refund Policy.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT OUTPUTS WILL MEET YOUR EXPECTATIONS.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR USD $100, WHICHEVER IS GREATER.
11. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.
12. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you via email or through the Service. Your continued use after changes take effect constitutes acceptance of the revised Terms.
13. Governing Law
These Terms are governed by the laws of the United States and the state in which we are headquartered, without regard to conflict-of-law principles. Any disputes shall be resolved in the state or federal courts located in that jurisdiction.
